Please read carefully the following provisions of Terms of Sale and Shipping Policy. This is a legal agreement between you and Swimmo Inc., a Delaware corporation ("Swimmo" or "we") regarding the purchases of Swimmo products through our shopping cart (the "Swimmo Checkout") and online website and/or other mobile services (collectively, the "Swimmo Website"). By placing an order, you acknowledge that you have read, understood, and agree to be bound by the following terms and conditions (the "Terms").
We currently accept all major credit, debit and prepaid cards (collectively, the "Credit Card(s)"), including Visa, MasterCard, American Express, JCB, Discover in the Swimmo Checkout. Depending on the country, we may offer alternative payment options including but not limited to PayPal, Apple Pay, Google Pay, European SEPA bank transfer or other local payment systems.
If you provide Credit Card details or other authorized payment method information to Swimmo, you authorize Swimmo, or a payment processor of its choosing to bill such card or to make such charges as applicable. By ordering a product or service on the Swimmo Checkout, you understand that you will be charged for the full amount at the time the order is placed.
If a payment is found to be suspicious, we may require additional verification of information (such as additional confirmation of your payment information) prior to the dispatch to verify that the charge is legitimate.
After successful purchase, you should expect an email from us with all the details. Your order confirmation email will reflect the address details, items ordered and the total amount charged. The receipt of an email order confirmation does not constitute our acceptance of an order or our confirmation of an offer to sell a product or service. We reserve the right, without prior notice and in our sole and absolute discretion, to limit the order quantity on any product variant, to refuse service to any customer and/or to refuse access to the Swimmo Website by any visitor or customer - especially in the event of repeating fraudulent activity.
Back orders and pre orders may be placed for products and services sold and to be sold through the Swimmo Checkout. If this is a case, while Swimmo endeavors to meet all its deadlines and to provide the product at the estimated time, delays inevitably may arise. If any personal information necessary to fulfil your order change after the time your order was placed and before packing starts, it is your responsibility to contact us with updated information (such as shipping address, email or phone number).
Depending on your country, you might be presented a choice between two shipping method categories - postal service and courier delivery - which differ in the shipping cost, the delivery time and the availability of tracking information. If postal service is selected, your parcel may be left in your mailbox or at the doorstep of the shipping address which is especially common within United States.
In rare circumstances, Swimmo may use a shipping method other than the one selected by you although we will try to adhere to your chosen method. We will try to switch to the similar method first or if the delivery method standard is downgraded, we will issue a refund of the difference in the shipping cost.
Swimmo uses an automated address verification system and shipping is done by external regional fulfillment partners. This allows us to reduce both the shipping cost and the delivery time greatly, but each order still needs to be processed by the fulfillment partner and packed manually.
As a general rule, Swimmo orders are dispatched the same business day from the order date for U.S. and European Union addresses and usually next business day for other regions. Please note that any issues with address verification will need personal care to verify the shipping details with you via email before dispatch.
We may show estimated delivery dates - although not guaranteed - those should be highly accurate as they are based on the previous deliveries to your country. Please note that shipping during peak seasons like Black Friday or Christmas may result in a delayed delivery due to both carrier and warehouse overload.
If estimation is not shown, we may not be certain enough to show them yet - then we ask you to allow up to 2‑6 weeks for delivery even though an order may be delivered in quicker time. While we strive to deliver all orders as quickly as possible, it's still an international shipping and it takes some time to arrive.
We are responsible for safe delivery of the parcel to the provided address. If it's 2 weeks past estimated delivery date and you have not received your order yet, please contact us. If a parcel seems to be lost in transit, we will take actions 4‑8 weeks from the dispatch date depending on the shipping method used.
We make all reasonable efforts to check the provided shipping details, including using automatic address verification methods, but it is your responsibility to provide accurate shipping information, email as well as phone number if needed. Swimmo is not responsible if address provided by you was invalid or outdated.
If the parcel is undeliverable due to an incorrect address information or if the buyer fails to collect it despite it being delivered to the correct address, it might be returned to the sender (fulfillment warehouse partner) as per the postal or the courier delivery service's policy. In such cases the buyer will be asked to cover the re-shipping cost as the original shipping service has already been provided.
In case the recipient fails to cover the import duties or declines the package - the shipping cost, the return shipping cost, as well as any additional fees levied by the delivery service or the fulfillment warehouse partner, will be deducted from the amount refunded after the parcel has returned to the warehouse.
If it looks like an error during fulfillment or carrier fault, we will cover the cost of the second shipment.
Based on our shipping experience we may show certain shipping destinations as safe from additional customs, duties and local taxes (this applies for example to United States and European Union currently), but in general all applicable customs fees, taxes and duties are the sole responsibility of the customer as they may change from country to country. Customs authorities require that we state the value of your order directly on your parcel which is the amount you paid during purchase.
Please note that on rare occasions, customs agents may delay the delivery of some packages at their discretion. Swimmo has no influence on delays imposed by customs office in your country.
You have the right to cancel your order if you changed your mind about your purchase after you placed it and before packing starts. After your parcel is shipped out you can only use 14-days change of mind return policy.
You have the right to return the product within 14 calendar days if you changed your mind about your purchase. In such case the shipping costs are covered by the customer. The unused goods must be sent back within 14 days of notifying the seller. Important - the return address will differ from the original sender's address. The correct return address will be provided in an email sent by Swimmo customer support.
The returned product must not show wear or damage and should contain all original documentation, packaging and all accessories. In case the product has not been returned to seller in a fully resalable condition, the seller reserves the right to decline a refund or deduct restocking fees. Except as set forth in these Terms, all other purchases are final and no returns shall be accepted after the set period.
Before issuing a refund you will be asked to sign the correction document of the original invoice per legal requirement of European VAT taxes. If the payment fees levied by the payment operator are non-refundable by the said payment operator, Swimmo reserves the right to deduct the corresponding amount from the refund. Cancelled payments (refunds) can only be sent back to the original payment method used in a charge. It’s not possible for us to send a refund to a different destination (e.g. another card or bank account).
By accessing or using the products, applications and services owned or operated by Swimmo, you are accepting the terms of EULA & Warranty terms and you are agreeing to be bound by these terms which are expressly incorporated herein as though set forth in full.
Swimmo may make changes to any products or services offered through the Swimmo Checkout, or to the applicable prices for any such products or services, at any time, without notice, especially in those cases when currency exchange rates needs to be adjusted.
Swimmo Checkout is an online service and as such is vulnerable to any technical service malfunction, especially in connection to our vendors (like database connection issues, inaccurate exchange rates) or other errors and Swimmo reserves the right to cancel any orders arising from abuse of such errors.
Because our products continue to evolve, we make all reasonable efforts to accurately display the attributes of our products, including the applicable colors. We try to ensure, but do not guarantee in any way, that information provided on the Swimmo Website is complete, accurate and up to date. As such, we make no representation as to the completeness, accuracy or correctness of information on Swimmo Website. All features, content, specifications, products, colors and prices of products and services described or depicted on Swimmo Website are subject to change at any time without notice.
Swimmo reserves the right, at its sole discretion, to change, modify, add or remove portions of these Terms, at any time. It is your responsibility to check these Terms. Your purchase means that you accept the version of these Terms from the date of purchase.
